Meet Anthony Kennedy, part II

With the confirmation of Elena Kagan to the Supreme Court today, I am again thinking about Anthony Kennedy. Our entire judicial system essentially is in his hands. But there’s been a new development since my last post – and that’s Elena Kagan.

I believe that Kagan was appointed not so much for her liberal views – which some liberals have even bemoaned are not liberal enough – but because of her persuasive powers. Over and over again she is described by people as being a brilliant teacher and I believe she has been appointed to try and steer Anthony Kennedy in the right direction. And I think this was a brilliant political move on Obama’s part.

But let’s be clear – Kennedy doesn’t have that far to go. On civil liberties he’s pretty good, he basically looks like a libertarian. See my previous post for my research about this.

The hope, though, is that Kagan can influence him around things like the Citizens United decision in the future – talk him down from his free-market ridiculousness and remind him of the humans that are sometimes crushed under the weight of the “free market.” It remains to be seen whether Kagan is this persuasive or not.
